Thank you for your interest in renting the Pottersburg Covered Bridge for your special event! Below you will find the Rental Agreement outlining our policies and fees. Please read the agreement carefully, once complete fill in the text boxes below with your information. After you submit your info, our friendly Tourism Services Coordinator will be in touch with you to answer your questions and finalize reservations. 

USAGE POLICY and USER AGREEMENT

 

This Usage Policy is a part of the User Agreement for use of the Pottersburg Covered Bridge (Bridge). The agreement is between the owners of the Bridge, the Union County Commissioners (UCC), the Union County Engineer (UCE) and their representatives and the individual(s) or organization(s) wishing to use the Bridge (USER). 

 

Should USER be found in violation of any the provisions of this policy, the UCC will consider the User Agreement null and void and the USER will forfeit all advance payments made to the UCC and be liable for all user fees and other expenses incurred, whether or not the event actually occurs. 

 

The User Agreement (Usage Policy) is the only agreement between the parties relative to use of the Bridge and no oral statements or prior written matter shall have any force or effect.

 

1. FEES FOR USE 

Rates for use of the Bridge are based on a 2-hour minimum and require a $100 deposit:

            Monday-Friday $25.00/hr.              Saturday/Sunday  $50.00/hr.

 

Rates do NOT include tables or chairs, set‑up or other special requirements such as security, extra lighting, excessive trash removal, etc.  Rates for the above service and additional equipment requested shall be charged at the current approved rates which are listed on the User Agreement.  Failure of guests and/or caterer to arrive or vacate the premises at the agreed departure time will result in an hourly overtime charge of 1 ½ times the hourly usage rate billed against the USER’s security deposit.

 

2. BOOKING POLICY

"Tentative" dates may be requested by a potential USER and will be held up to ten (10) days prior to the proposed event, at which time User Agreement must be signed and the necessary deposit made to confirm the date. After ten days the hold will be vacated and the date released. No reservation will be considered booked without a signed agreement and security deposit.

 

3.  SECURITY DEPOSIT/ CANCELLATION

A $100 security deposit is required to confirm a reservation.  The security deposit is returned to the USER within two weeks after the use of the Bridge unless overtime charges, unusual clean-up or damage repair is required. Written notice of cancellation must be received within two (2) calendar days before the reserved date.  A complete refund of the security deposit will be issued within two weeks after receiving written notice of cancellation.    If cancellation notice is not received in writing, the security deposit will not be returned.

 

 

4.  INSURANCE

Where applicable, proof of general liability insurance in the amount of $1 million will be required.  Also, as applicable, proof of workers compensation insurance covering the USER, caterer, vendor or their employees working on or in connection with the event or exhibit described herein in accordance with Ohio Workers Compensation Laws and an "all States endorsement," may be required. In general, if goods or services are being sold or exchanged at the Bridge the USER will be required to provide proof of insurances as stated above.

 

5. INDEMNITY

The USER agrees to conduct activities upon the premises so as not endanger any person lawfully thereon.  The USER expressly agrees to protect, indemnify, and save harmless the UCC, the Union County Engineer, their representatives, and employees from and against any and all liability, damage, or expense for, upon or by reason of (i) any injuries, including injuries resulting in death, received by any person, firm, or corporation to his, her or its property, and (ii) any loss of property received, done to, occurring to, or about the Bridge used by the USER thereunder, unless the same results from the negligence of the UCC, the UCE, their employees or representatives in the operation or maintenance of the Bridge and premises, it being expressly understood that the USER shall pay for any and all damages to, loss of, or theft of the Bridge or property which occurs in connection with the USER’s use of the premises under this agreement unless caused by the negligence of the UCC, the UCE, or their representatives, or employees.

 

6.  CONDITION OF PREMISES.

At the expiration of the time of occupancy hereinabove set forth, the USER shall leave the premises of the Bridge in as good condition and repair as before USER’s use thereof.  Should the premises or property of the Bridge be damaged while being used by the USER or by any person admitted to the premises by or with consent of the USER, the USER shall pay to the UCC upon demand such sum as shall be necessary to restore the Bridge or property to its condition at the commencement of the User Agreement, fair wear and tear excepted.  

 

7. MOVE‑OUT

If any such property is not removed within the stated time, the UCC or the UCE may dispose of the same as unclaimed property pursuant to the provisions of Ohio Law.

 

8. COMPLIANCE WITH APPLICABLE LAWS ‑ CONDUCT.

The USER will comply with all laws of the United States and the State of Ohio, all ordinances and resolutions of the Village of North Lewisburg, Allen Township, and the counties of Union and Champaign. The USER will comply with all rules, regulations, and lawful requirements of the Police and Fire Departments or other authorities of the Village of North Lewisburg, Allen Township and the counties of Union and/or Champaign having jurisdiction in the circumstances.

 

 

9.  ALTERATIONS, SIGNS AND POSTERS

The USER shall not do, or permit to be done, upon said premises anything that will inure, mar or in any manner deface the Bridge, and will not drive or install, or permit to be driven or installed, any nails, hooks, tacks, or screws in any part of the Bridge, and will not make or allow to be made any alterations of any kind whatsoever to the Bridge.  The USER shall not post or exhibit or allow to be posted or exhibited any signs, advertisements, posters, or cards of any description on any fixed part of the said premises without permission from the UCC or the UCE.

 

10. ENTERTAINMENT STANDARDS

No performance, exhibition or entertainment shall be given or held at or on the Bridge which is illegal, indecent, obscene or immoral, or which is wholly without redeeming social value, pornographic, or which contains sexually-oriented material harmful to minors or patrons.

 

11. CONTROL OF PREMISES ‑ INSPECTION 

The UCC, UCE, or their duly authorized representatives shall have the right to enter the Bridge premises at all times during the period covered by this User Agreement. 

 

12.  PROPERTY LOSS/DAMAGE ‑ NO RESPONSIBILITY 

The UCC, UCE nor its representatives, or employees shall be liable for any loss, damage or injury to property of any kind delivered to the Bridge, either prior to, during or subsequent to the use of the Bridge by USER. The UCC, UCE nor its representatives shall be liable for damage arising out of water or wind coming through the roof, windows, openings, or otherwise.

 

13.  USE OF TRAIL BY THE PUBLIC 

The USER understands the Bridge is located on a multi-use trail which is open to the public.  The trail runs from Bridge and to the Village of North Lewisburg. Public use and access to the trail from North Lewisburg can not be closed.   No portion of the trail, except the Bridge, shall be obstructed or caused to be obstructed by the USER. Notification and coordination with the village is required as part of the User Agreement.

 

14. FLAMMABLE MATERIAL, FIREARMS, WEAPONS, SPECIAL EFFECTS

No flammable materials will be permitted to be used for decoration; and all materials used for decorative purposes. The USER shall not without the written consent of the UCC, the UCE or their designated representatives, put up or operate any engine, motor, or machinery upon the Bridge. Use of candles, burning fluids, camphene, kerosene, naphtha, or gasoline on the Bridge, property or premises is prohibited. Firearms are not permitted on the Bridge, property or in parking areas. 

 

15.  SALES/COLLECTIONS

Where food, arts and crafts, souvenirs, novelties, records, tapes, and the like, are sold in conjunction with an event, all arrangements for this activity will be coordinated through the UCC or their representative. No collections, whether for charity or otherwise, shall be made or attempted without the prior written consent of the UCC or duly authorized representative.

 

16. FOOD AND BEVERAGE

There are no areas for food and/or beverage preparation on the Bridge.  When used, the USER must exercise or ensure strict sanitary preparation and disposal of such food or beverage.  The USER assumes the responsibility of any action of a caterer or solicited food provider during the time the vendor is in premises on behalf of the USER. The intent to use a solicited food provider must be made known when requesting Bridge reservation. Alcoholic beverages are not permitted to be sold or consumed on the Bridge, trail, property, or parking areas.   

 

17. OBJECTIONABLE PERSONS

The USER does hereby assume responsibility for the acts and conduct of persons admitted to the premises with the consent of the USER or with the consent of USER’s representative or employees. The UCC and the UCE reserve the right, but does not assume the duty, to eject, or cause to be ejected from the premises any rude, insolent, drunk, intoxicated, disorderly, or similarly objectionable person or persons; and neither the UCC, the UCE nor any of its officers, representatives, or employees shall be liable to USER for any damages that may be sustained by USER through the exercise of such right. 

 

18.  NO PARTNER OF JOINT VENTURES

Nothing contained in this agreement shall be deemed to constitute the UCC, the UCE, and the USER as partners or joint ventures with each other or with any other party. It is expressly understood the USER is, and shall at all times be considered and construed to be independent, and in no way the employee or representative of the UCC or the UCE.

 

19.   NON‑DISCRIMINATION

The USER shall not discriminate in the use of the premises against any person because of race, creed, color, religion, national origin, political belief or affiliation, age or sex.  Adult chaperones are required for congregating minors.

 

20.  LAW ENFORCEMENT

It shall be the obligation of the USER to furnish adequate police protection for the event if deemed appropriate by UCC or the UCE. 

 

21.  PARKING PLANParking at the Bridge is limited.  A description of how the USER will manage parking shall be submitted to the Union County Convention and Visitor’s Bureau.

 

22.  REMOVAL OF TRASH AND MATERIAL. 

The UCC reserves the right to charge the USER for the removal of trash and rubbish. 

 

23.  PROPERTY DAMAGE.

a.       It is understood that the USER has inspected the Bridge and premises and that the same are in proper condition for the uses contemplated thereunder, and that there is no existing damage to the Bridge or premises except that which has been noted in writing.

 

b.       That at the conclusion of the event (unless otherwise mutually agreed in writing) which is the subject of this agreement, the representatives of each of the parties shall inspect the premises to determine damage to the Bridge property or premises if any, which has been incurred or suffered in connection with the event. If parties agree as to damage, payment due the UCC for extra services and personnel furnished by the UCC or the UCE, a detailed description thereof, and the amount thereof, shall be reduced to writing and signed by representatives of both parties.  

 

c.   If the parties cannot agree as to the amount owed to the UCC, or the UCE, each party shall make a separate list of damages, and the amount due for extra services in personnel. 

 

24. MAXIMUM TICKET SALES ‑ OCCUPANCY LOAD: 200

The occupancy load of the bridge is 200 people. The USER shall not sell, cause or allow to be sold or issue admission tickets in excess of the capacity of the Bridge.  There shall not be admitted to the Bridge or premises a larger number of persons than is allowed by the occupancy load.

 

25. FEE EXCLUSIONS OR EXEMPTIONS

Any Union County or Village of North Lewisburg government agency who requests to reserve the Bridge will be exempt from hourly user fees. All above-mentioned rules and regulations will apply.
